Terms of Service

1. Acceptance of Terms

By accessing or using ArchNova (the “Platform”), operated by Ganexa Consultancy Services Pvt. Ltd. (“Ganexa”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

ArchNova is an AI-powered enterprise architecture platform that provides modelling, analysis, collaboration, and governance capabilities. The Platform is provided on a subscription basis as described in our pricing plans.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.

4. Your Data

You retain all rights to the architecture data and content you create or upload to the Platform (“Your Data”). You grant Ganexa a limited licence to host, process, and display Your Data solely to provide the Platform services. We will not access Your Data except as necessary to provide support or as required by law.

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Platform
• Interfere with or disrupt the Platform or its infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Platform
• Use the Platform to store or transmit malicious code
• Resell or redistribute the Platform without written consent

6. Subscription & Payment

Paid subscriptions are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Free trial access is provided for evaluation purposes and may be revoked at any time.

7. Service Level Agreement

Enterprise plans include an SLA with 99.9% uptime commitment. Details are provided in the Enterprise Service Agreement. Starter and Professional plans are provided on a best-effort basis.

8. Limitation of Liability

To the maximum extent permitted by law, Ganexa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9. Termination

Either party may terminate the subscription at any time. Upon termination, you may export Your Data for 30 days. After that period, Your Data will be permanently deleted. We may suspend or terminate your access immediately if you violate these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.
